Uni 10-07-2017 - Guidance on pricing transfer transaction

On 28 Apr 2017, MOF issued Circular 41/2017/TT-BTC guiding Decree 20/2017/NĐ-CP about tax administration for enterprise incurred pricing transfer as follows:

-          Regulate comparison analysis, opt independent comparison entities  

-          Methods to compare to determine cost of pricing transfer

-          Declare pricing –transfer information with form 01, 02, 03, 04. Taxpayers declare the forms in accordance with Decree 20/2017/NĐ-CP replacing 03-7/TNDN issued together with Circular 156/2013/TT-BTC and submit together with CIT Finalization form 03/TNDN.

-          Guidance on files to determine pricing transfer

-          Apply regulations of exemption to prepare pricing transfer files
